GENERAL TERMS & CONDITIONS OF PURCHASE AND ATTENDANCE AT AN AUCTION SALE

 

  1. Occupational Health and Safety Standards apply to all site attendees and their contractors.

  2. No Children under the age of 16 are allowed on-site.

  3. It is a condition of entry that all attendees must not endanger themselves or others by way of action, inaction, negligence or intent.

  4. It is a condition of entry to the auction/sales site that all attendees must comply with any directions given by Premier Auctions staff, agents or the site controller.

  5. Appropriate clothing must be worn to inspections, auction days and delivery including sturdy covered shoes.

  6. Mandatory Personal Protective Equipment may be required to be worn prior gaining approval of entry to the site.

  7. No climbing on, starting or operating of machinery, plant, equipment, vehicles and other chattels without the permission of Premier Auctions Pty Ltd staff.

  8. Attendance at and participation in the auction sale is at the discretion of the Auctioneer.

  9. All buyers must be 18+ years of age.

  10. All buyers must register prior to bidding and produce appropriate I.D.

  11. Online Auction registrations may require credit card validation.

  12. The highest bidder shall be the purchaser (subject to any reserve price) binding them and constituting a contract to the lot sold.

  13. The Auctioneer has the right to refuse any bid and the vendor is entitled to one bid at the time of sale.

  14. A 20% deposit may be required on the fall of the hammer.

  15. All goods lie at the purchasers risk on the fall of the hammer and thereafter the vendor and the auctioneer will be free from all responsibility for safeguarding the goods.

  16. All goods purchased must be removed from the site within two working days unless specific removal timeframes have been nominated by the auctioneers.

  17. Goods not collected within the nominated time frames will be deemed abandoned. Storage and other handling charges will apply unless prior arrangements have been made with the auctioneers.

  18. No delivery of items will take place during an auction.

  19. Payment in person at our Auction Rooms is accepted by cash, bank cheque, direct deposit, EFTPOS (a $1 charge applies to EFTPOS) or credit card (MasterCard and Visa only). A 2.2% surcharge applies to credit card payments and the invoice will be increased accordingly.

  20. By registering to bid at an online auction with a credit card the buyer recognises and agrees that the nominated credit card may be charged for any outstanding amounts plus any surcharges.

  21. Payment of online auction invoices with a total of $1000 or less will be processed directly to the purchaser’s nominated credit card. A bank surcharge of 2.2% applies.

  22. Online auction invoices with a total over $1000 will have a $500 deposit charged to the buyers nominated credit card. A bank surcharge of 2.2% applies. The balance of the invoice is payable by cash, bank cheque, direct deposit, EFTPOS (a $1 charge applies to EFTPOS) or credit card (MasterCard and Visa only). A 2.2% surcharge applies to credit card payments and the invoice will be increased accordingly.

  23. Title of goods does not pass to the purchaser until full payment has been received as clear funds.

  24. Any goods resold under default of the auction contract, whether by auction, private treaty or otherwise, will be accountable to the original vendor. The purchaser will be liable for any shortfalls, losses and costs involved but will not be entitled to any profit from such resale.

  25. All descriptions and measurements are approximate only and all goods are sold as is where is.

  26. The purchaser must rely on their own inspections and enquiries as to the working condition and description of the goods. All goods are sold as is where is.

  27. No warranties are given either expressed or implied by the auctioneer or their agents or any entity associated with Premier Auctions Pty Ltd. All goods are sold as is where is.

  28. The catalogue is for use as a guide only and the auctioneer does not warrant its accuracy. Buyers are encouraged to personally inspect goods prior to placing a bid.

  29. All electrical goods must be inspected by a qualified electrician prior to resale or installation.

  30. All plant and equipment offered for sale may not comply with current safety and operational legislation and is sold for the purpose of wrecking, renovation or repair.

  31. All plant, equipment and chattels must be inspected by a qualified person prior to installation, use or resale.

  32. Motor Vehicles are sold registered to Licensed Queensland Motor Dealers only and sold unregistered to the general public. No Statutory Warranty applies. No Cooling Off period applies. Note: It is illegal to drive an unregistered vehicle on the road. Premier Auctions Pty Ltd recommends use of a tow truck, vehicle carrier or permit to relocate a vehicle.

  33. Licensed Motor Dealers must produce a copy of their license. Vehicles must be purchased in the licensed name and paid for by the licensee.

  34. Premier Auctions Pty Ltd will charge a GST Inclusive buyer’s premium to all lots sold.

  35. It is the purchaser’s responsibility for the moving, loading, dismantling and any site/premises make good of the purchased items. Premier Auctions Pty Ltd staff is available for access only.

  36. The registered bidder and purchasers agree that they are solely responsible for their staff, contractors or agents that may be on-site.

  37. All work carried out on site will be performed in a manner compliant with the relevant State Occupational Health and Safety Legislation. All work undertaken on the site must be performed by suitably qualified and insured persons.

  38. All tradespersons must possess the relevant licences to undertake plant disconnection and removal of plant activities. Copies of these licenses may be requested prior to the commencement of work and copies/license details may be retained by Premier Auctions Pty Ltd.

  39. Copies of Insurances - PI/PL and Workers Compensation may be required to perform work on the site and copies may be retained by Premier Auctions Pty Ltd.

  40. All work above 2.0 metres will require the use of certified equipment. All equipment used will bewithin the safe test date requirement for such equipment and in approved condition. All work at heights risks will remain under the control of the purchaser, their agents or contractors.

  41. All equipment brought onto site must be considered safe and fit for use and be tested and tagged as required by legislation.

  42. All disconnection and connection of electrical, water, plumbing, compressed air, gas and refrigerant lines must be conducted by a qualified tradesperson.

  43. All decommissioning, dismantling, demolishing must be conducted by a qualified person.

  44. Operation of any lifting, access and transport equipment will be conducted by a licensed person.  Lifting gear and equipment is not provided by the auctioneer.

  45. All handling and transport of chemicals and dangerous/hazardous material must be conducted by a licensed or qualified person.

  46. Online auction and sale services depend on third party service providers. Premier Auctions Pty Ltd does not assume liability for any interruption or loss associated with the provision of these services by third party providers.

  47. Online Auction closing times are subject to time extensions (known as “soft close”) based on successful bid timing. If a bid is received within 5 minutes of the auctions nominated closing time, the lot will remain open for bidding until such time as no further successful bids have been received within the extended 5 minute timeframe. There is no limit to the amount of times that the open for bidding time can be extended.
